James M. Carlson
Jim’s practice involves complex commercial matters in state and federal courts including multi-district litigation as well as mediation and arbitration proceedings. He has wide-ranging litigation experience with contractual disputes, commercial real estate litigation, professional liability issues, securities fraud, and intellectual property litigation. Jim has also counseled clients regarding pre-litigation strategies. Additionally, Jim has experience with handling electronic discovery issues and counseling clients regarding appropriate standards for maintaining and archiving electronic documents.

Complex Commercial Litigation

Successfully defended a Fortune 100 telecommunications company in a multi-million dollar breach of contract case regarding the implementation of a cellular network in Poland. A corporation brought claims of tortious interference, breach of fiduciary duty, and breach of contract against the telecommunications company. Jim worked closely with telecommunications experts in developing, refining, and focusing defense strategy and interpreting the relevant technology. Jim worked with courts in both Illinois and Poland to bring the matter to a successful conclusion.
Real Estate Litigation

Represented a global financial services firm in two multi-million dollar lawsuits against national real estate services providers alleging fraud, multiple claims of breach of contract, and breach of fiduciary duty. Jim successfully argued for the production of electronic documents and digital versions of documents crucial to the litigation. He deposed and defended numerous witnesses, including financial and real estate experts. Both matters settled.
Services Contract Litigation
Medical Privileges Arbitration

Represented a major Chicago area hospital throughout administrative proceedings that challenged a petitioning physician’s ability to obtain privileges at the hospital. At arbitration, Jim successfully argued that the physician had violated the bi-laws of previous employers, was a litigation risk, and therefore should not be granted privileges. Jim further counseled the hospital on the possibility of post-arbitration litigation related to this matter.
